Casa In Italia GmbH rent this house by Exclusive Villas DB GmbH and we will send you a copy of this Booking Conditions that the tenant has to sign.

Exclusive Villas DB GmbH is an Agent with power of attorney of the Principal (owner of the property). The contract come into force on payment of the first payment to Exclusive Villas DB GmbH. Your payment will be taken as your and your party’s acceptance of the following conditions:
1. BOOKING
A deposit of 30% of the property rental must be paid. no contract with us will exist until we have received this amount and have subsequently confirmed your booking. Should you later cancel, cancellation charges will become payable in accordance with paragraph 3.
2. PAYMENT OF THE BALANCE
The balance of the payment must be paid at least eight weeks before departure. If the balance is not received by us by the due date, we shall be entitled to cancel the booking without prejudice to our claim for cancellation charges, and to retain the deposit. For bookings made within eight weeks of departure date, you will be required to pay the full cost of your holiday at the time of booking.
3. CANCELLATION BY YOU
It is agreed between us that should you wish to cancel all or any part of your booking, or that the booking is cancelled by us due to non-payment, then we shall be entitled to the following percentage of the holiday cost.

Cancellations must be received in writing by us.
4. ALTERATIONS / CANCELLATIONS BY US
Though it is unlikely that we will have to make any changes to confirmed arrangements, it does occasionally happen, and we will advise you at the earliest possible date. If for any reason beyond our control we are unable to provide you with the property you have booked, we reserve the right to transfer you to a similar property. However, if this is not possible or you do not wish to be transferred, we will cancel the booking and refund the amount paid to us for the property, but we will not be liable for any cancellation charges for travel arrangements.
5. NUMBER OF PEOPLE / REPLACEMENTS
The number of people must not exceed the number of sleeping place indicated in the website. Should the keyholder find more persons than those stated, it is totally up to his discretion to ask the clients to vacate the house. Infants (children under 2 on date of return) are not included in occupancy figures. However many owners limit the number of infants/toddlers. Each child over 2 (whether sleeping in a baby cot or not) will be counted as part of the villa occupancy.
6. COMMERCIAL USE
Should clients intend to use a villa for any type of commercial use such as photo shoots or filming this should immediately be advised at the time of booking. Such use will only be allowed with the written consent of Exclusive Villas DB GmbH, who in turn will implement specific arrangements and stipulations thus imposed by the villa owner. No private parties, weddings, wedding receptions or large gatherings are allowed in the properties without written permission from Exclusive Villas DB GmbH no camping is permitted on the property grounds.
7. ARRIVAL AND DEPARTURE TIMES
Clients must arrive between 3 p.m. and 7 p.m. and leave before 10 a.m. on the day of departure. If the client is late, advance notice must be given in writing. In case of flight delays or inconvenient while travelling, clients should contact our office or the local housekeeper. Late arrivals are very difficult to be arranged and the housekeepers may reserve the right of asking for an extra fee, depending on the single case. In any case it is not possible to arrange arrivals after 10 p.m. It is up to the keyholder’s discretion to decide whether or not to allow clients to enter the house at times other than those stated. Exclusive Villas DB GmbH declines all responsibility in the matter.
8. DAMAGE DEPOSIT
A security deposit as stated in the price list is payable by credit card. This is to cover the cost of any damage or breakages during your stay to the property or the contents. This amount, less any applicable claims, will be returned to you the week after your departure. Failure to pay the deposit can result in the keyholder refusing entrance to the house.
9. PETS
Pets are not accepted.
10. COMPLAINTS
We have visited and checked each property and the descriptions in the brochure are therefore accurate and made in good faith. However we decline all responsibility for any modifications made by the owners without our knowledge. We also do not accept responsibility for the breakdown of the supply of water, gas nor electrical and telephonic lines, including electronic devices and internet connection, though we will use our best endeavours to arrange for problems to be solved. If you have any problem during your stay which cannot be satisfied by dealing directly with the owner or manager of the property, you should contact us immediately. It is impossible for us to claim compensation from the owner after you have returned from your holiday if you have not recorded the problems with us during your stay. Complaints lodged only at the end of the holiday period will not be taken into consideration. Clients who abandon the house without authorisation from Exclusive Villas DB GmbH lose all rights to any eventual refund or rebate.
11. CLEANING
The property will be clean throughout at the beginning of the rental period and on Wednesdays and it must be left by the tenant clean throughout at the end of the rental period. It is usually possible to arrange an extra maid service but this cannot be guaranteed. The costs for extra maid service vary in different areas -approximately 15 Euro per hour – and are paid locally. If a maid is booked in advance her service cannot be cancelled locally without payment. Linen is changed on Wednesdays and Saturdays.
12. BEHAVIOUR
The client signing the contract is responsible for the correct and decent behaviour of his party. Should the client and his party behave in a manner that is not acceptable by civilised standards, the keyholder may ask the client and his party to vacate the house.
13. PEOPLE WITH HEALTH ISSUES
People with disabilities or health issues should verify with us the suitability of the property that they are considering our properties are in the countryside, and bugs, spiders, wasps and domestic animals are common in rural settings. Please take note of this in case someone in your group has serious allergies.

14. LOW SLUNG CARS - VANS - MINIBUSES
Most of our houses are located in the countryside. Some of them can be accessed only by unsealed roads and driveways. We therefore advise people intending to take a sports or low-slung car on holiday, to check with us first whether the access to the property allows for such a car. We advise against the use of vans and minibuses. Please always check with us, at the time of booking, if you are planning to use this type of vehicle when staying at one of our properties.
15. SWIMMING POOL
The pool opening date is 22 June 2019 (20 April 2020) until 12 October 2019 and 10 October 2020) (unless otherwise agreed in writing with Exclusive Villas DB GmbH and with possible extra costs).
16. HEATING
Heating costs are not included in the price and must be paid separately to the owner. Please note that heating in Italy, when not subject to restrictions by the local Government, is more expensive compared to other countries. If you look for a property in low season, make sure to ask for an estimate of the heating cost. You may be asked a supplementary deposit for heating expenses.
17. ELECTRICITY AND WATER
Italy is probably one of the few countries in the world where the government has introduced a system of electricity limitators to contain the national consumption. This means you must be careful when using more than one appliance at once because the limitator will shut the electricity off. Please use it sparingly during the summer months.
The house is not served by municipal waterworks. The water tank must be filled if necessary. The price per week includes two (n°2) fillings while the price for the following ones must be payed locally (90 euro for each filling).
The tank is equipped with a red warning light for the residual water level. The warning light comes on when the residual water level is equal to 15% of the total. The light is located near the cistern, in the garden near the parking area. When the red light comes on, it is urgent that the Conductor signals the need to fill the cistern. Filling may require a waiting time of 48 hours. During this wait it is important that the Conductor uses water sparingly.
18. INTERNET CONNECTION
Unfortunately, Internet is still not a standard in Italy, especially in the countryside. We're doing our best to offer you this service, but in these villas, where an Internet connection is available, please consider that sometimes it is very slow. Frequently only EDGE or 3G is available what only permits to receive the emails. Many of our properties have an internet connection. From our experience, when a connection is interrupted due to technical reasons beyond our control, it is unfortunately very difficult, despite our efforts, to receive immediate assistance from some of the internet providers operating in Italy. We therefore strongly suggest that those who need to access their emails should bring their own BlackBerry, or a similar portable device. Please note that in any case we cannot accept responsibility for lack of these services (see also item 10).
19. VALUABLES
Valuables left at the property are at the clients risk. Neither Exclusive Villas DB GmbH nor the owners (nor their staff) are responsible for their loss.
20. RESPONSABILITY
We do not accept liability for any loss, damage or additional expenses incurred by you or any member of your Party in connection with the holiday, whatever the cause. We are not liable for any injury, death, loss,
inconvenience or damage to personal belongings of members of your Party or guests during your stay. You are responsible for any damages any person or guests could cause during your stay. The Tenant is responsible of the diligent and correct custody of the Real Estate Unit, in particular the diligent use of the alarm system and of the external security / solar doors of the Real Estate Unit.
21. INSURANCE
The tenant confirms to have an third-party insurance that covers any damages could be done on the property. This policy will hold the OWNER of the property harmless and will guarantee:
- the OWNER, for any damage caused by the Tenant to persons, movable property and / or property / appliances in the use of the Real Estate Unit;
- the Tenant, for any damage incurred during the use of the Real Estate Unit and its appliances / movable and / or real estate assets.
22. SERVICES
The Tenant is aware of the obligatory nature of the services indicated in annex.
23. SPECIAL NOTES
- The entrance bar to the dirt road has a manual opening lock and must always be kept closed.
- The large shatter-proof windows are to be handled with care for the weight and to be used with care for the transparency.
- The large iron frames are to be moved with caution due to the weight and must always be closed when the Tenant leaves the house.
- The alarm system must always be entered when the Tenant leaves the house even temporarily.
- The motorized awning has a large size and has to be kept always closed in the event of wind.
- The internal kitchen is open flame powered by gas, to be closed after use.
- The pool has a compact size, is not suitable for swimming and diving. Spills of water could make the concrete floor of adjacent terraces slippery.
- Access forbidden to the roof of the house.
- Children must be supervised by an adult during the stay.
24. PRICES
The rental prices include the villa rental plus a surcharge by Exclusive Villas DB GmbH paid by the tenant.

ANNEX:
• Appointed for the check in and check out service.
Check-in must be between 3.00 pm and 7.00 pm on Saturday. Exceptionally, and subject to prior notice by the Conductor or Exclusive Villas DB, the reception may take place at different times. The check-out must take place before 10.00 on the last Saturday of the stay
• Electricity
• Water. Exclusive Villas DB informs the Tenant of the fact that the Real estate unit is not served by the aqueduct. The Tenant must promptly report to the local agent or to the Exclusive Villas DB the need for filling when the red warning light placed near the external parking area is lit. The red light indicates a residual water level of approximately 15% of the total. The availability of the supplier and the filling could take 48 hours. The price per week includes two (n°2) fillings while the price for the following ones must be payed locally to the local property manager (90 euro for each filling).
• Gas for cooking (heating gas not included to be quantified separately based on consumption)
• Air conditioning (in the bedrooms)
• Satellite Wi-fi
• Change of bed linen on Saturdays and Wednesdays
• Change of towels and pool towels on Saturdays and Wednesdays
• Cleaning on Wednesdays as well as Saturdays (only for stays longer than one week) (one person, from 10:00 am to 13:00 pm), with waste collection
• Cleaning at the end of the stay (two people, from 10:00 to 15:00), with waste collection
• Pool cleaning and pH control on Wednesdays and Saturdays in the morning
• Basic package for the week:
    o Each bathroom has 1 liquid hand soap and a roll of toilet paper.
    o The kitchen is equipped with 1 roll of kitchen paper, 1 pack of litter bags, 1 flat soap box, 1 washing machine soap box, 1 dishwasher soap box, 2 sponges
• Welcome pack: 1 bag of milk, 2 bottled water, 1 bottle of local white wine, 2 kilograms of fresh fruit, 1 kilogram of bread.
25. DISCLAIMER
For the period from ____________________ 201_ and ___________________ 201_ I, __________________________ (“Lessee”) will be leasing the property located in Contrada Sichilli, Strada Provinciale 19 Noto-Pachino, km.10.9, 96017 (Siracusa) and all of the premises thereof, including the swimming pool, the gardens and all installations, facilities and accessories in and about this property (the “Premises”).
RELEASE OF LIABILITY: I agree that I will keep and maintain the Premises and surrounding property clean and in good condition during my stay. At the end of my stay I will return the Premises in the same condition in which I received them, ordinary wear and tear excepted. I assume full responsibility for use of the Premises during my stay.
I, on behalf of myself and all of my family members, friends, guests, and other third-party invitees (collectively, the "Guests") acknowledge and agree that we are residing at the Premises at our own risk, and assume all risk of injury, illness, damage or loss to me or any other Guest or my property or the property of any Guests that might result, including without limitation, any loss or theft of any personal property. I agree to indemnify and hold harmless Owners and their respective employees, representatives, agents and affiliates, and each of their successors, assigns, personal representatives, heirs, executors, administrators, and agents (collectively, the "Released Parties"), from and against any obligation, liability, costs, expenses, and other damages arising out of my or any other Guests' use of the Premises and/or surrounding property.
I, on behalf of myself and the other Guests, release and discharge the Released Parties from any and all present and future claims, causes of action, damages, obligations and/or liabilities of any type or kind (“Claims”), whether known or unknown, arising out of the activities in, on or about the Premises, including without limitation, Claims arising out of the negligence, action or failure to act of any of the Released Parties, except to the extent that the Claims arise from the gross negligence or willful misconduct by any of the Released Parties. This release of liability includes without limitation injuries or damages which may occur as a result of any use of the Premises or surrounding properties.
This Agreement and Release of Liability is intended to be as broad and inclusive. If any portion hereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect. This Agreement shall be binding on the successors, assigns, agents, personal representatives, heirs, executors, and administrators of the parties hereto.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS AGREEMENT AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. BY IT I AM WAIVING ANY RIGHTS THAT I MAY HAVE TO BRING A LEGAL ACTION OR TO ASSERT A CLAIM AGAINST ANY OF THE RELEASED PARTIES FOR THE MATTERS DESCRIBED IN THIS DOCUMENT.
26. LAW-JURISDICTION
In the event of any dispute concerning the terms and conditions of this contract, the court of law of Altdorf will have jurisdiction and Swiss Law will be applied.
